(SeeNews) - Sep 26, 2014 - Austrian utility Salzburg AG said Wednesday it has reached an
out-of-court settlement with its former traffic head Gunter Mackinger under which he agreed to a partial retirement plan.
The iPhone maker reached an
out-of-court settlement in a case in which it was being sued by consumers, who overpaid for e-books due to price-fixing between the tech giant and publishers, the BBC reports.
The new law on traffic stipulates no
out-of-court administrative settlements for dangerous violations, which put people's lives at risk.
But last week the court heard an
out-of-court deal was reached.
The overwhelming majority of people handed
out-of-court disposals do not commit further offences.
The draft directive, which amends Regulation 2006/2004 and Directive 2009/22/EC, aims to guarantee access to
out-of-court dispute settlement, regardless of the type of goods or services concerned and the place of purchase in the European single market (in the consumer's country of residence or any other).
The airport company then launched legal action against the pair but an
out-of-court settlement was reached in October 2008 and all parties entered a confidentiality agreement to ensure the details remained private.
Its authors, Dr Roger Grimshaw and Helen Mills, said the fall in the number of cases was an "indication perhaps of the impact of the new
out-of-court penalties as well as the effect of stricter prosecution standards".
Kapital has learned from sources in the court that the two companies requested that the court hearing set for Friday be postponed, explaining that they need more time to find an
out-of-court solution.
