negligent fraud

negligent fraud

A false statement of a material fact, made without any intention to deceive, but upon which someone else relies to their detriment and is injured. An example would be a real estate agent telling a buyer that all the appliances are new when, in reality, the agent didn't know, but thought they looked new.
