Dismissal of Petition

A court's decision not to hear a case any further. Generally, this occurs because of some defect in the petition. For example, one party may not have standing to sue, or a prosecutor may not have met the burden of proof. In the United States, dismissal without prejudice leaves the petition open to be re-filed once the defect is rectified. However, dismissal with prejudice means the matter is closed.
