The lower court held that this too was extortion, as "the allegations of sexual misconduct were tangential to the business dispute." This was, however, reversed on appeal, mainly because the
attorney letter did not overtly threaten to turn anyone in, report someone to the authorities, or public expose or ridicule anyone -- he merely threatened to expose the names to court where the complaint was to be filed.
