sequestration order

sequestration order

A court order authorizing the seizure of personal property, or the rents or other income from real property,to be kept in safety under court supervision pending the outcome of litigation between the parties.The order is usually issued only when the creditor can prove that the debtor intends to fraudulently remove or spitefully damage the property to the detriment of the creditor. Normally the creditor requesting the order must post a bond in order to reimburse the debtor for his or her damages if it later turns out that the order was wrongfully entered.
