A sale of improved properties before they are built; common with condos and subdivisions. Presales are binding contracts. If the construction is completed, the buyer must purchase the property. Defaulting purchasers could risk more than the loss of their earnest money or their reservation fee. Under certain circumstances they could be liable for additional damages if the market takes a downturn and the property cannot be sold for a sum equal to or greater than the presale price.
