mesne profits

Damages due from one who is in wrongful possession of property, usually measured by the fair market rental of the property during the time period of the wrongful possession.This is damage for the possession itself; not damage for injuries to the property such as cutting down trees,destroying carpet,or flooding the basement.If the trespasser made improvements to the property, in good faith and believing himself or herself entitled to possession, then the value of the improvements may be used to set off any judgment for mesne profits.
