incorporation by reference A method of including all the terms of one document into another document without having to spell everything out. Deeds will frequently make reference to restrictive covenants on file in the real estate records at a certain book and page number and incorporate them by reference into the deed itself. In that manner, any purchaser of the land is bound by the restrictive covenants, without getting into arguments about whether or not they had constructive notice because of the public filing.
