excess land

    0.03 sec.
excess land

Land taken by eminent domain in a condemnation proceeding, but which is greater than the amount actually needed for the project in mind.A government may condemn excess land because the portion remaining after the amount actually needed may be rendered completely useless. In such a circumstance, the authority would have to pay for the condemned land and pay damages for the loss in value of the remaining land. It may be cheaper to simply take all the land and then attempt to sell the excess, especially if there are several excess parcels that are contiguous to each other.
