Section 29 of the Public Service Management and Employment Act 1988, which is now s.187(f) of the 2008 Act, provided that a Director-General could take action if an officer had "contravened, without reasonable excuse, a provision of this Act or a code of conduct".
However, neither the Act nor the Codes clarified the vague disciplinary terms in the Public Sector Management and Employment Act 1988, such as "disgraceful or improper conduct" and "unfitness" for service.
The Public Service Management and Employment Act 1988, s.29(3), now section 188 of the Public Service Act 2008, provided the following examples of disciplinary action:
