United States v. South-Eastern Underwriters Association A Supreme Court case in the United States in which it was held that the insurance sector was responsible to the Sherman Act (and could therefore be found in violation of anti-trust laws) and that the government had the ability to regulate insurance pursuant to the Commerce Clause of the Constitution. The decision was made in 1944; the following year, Congress passed the McCarran-Ferguson Act, which exempts insurance from most anti-trust law. Want to thank TFD for its existence?
