| The Federal Trade Commission announced in January that it had recovered $25 million to settle allegations of deceptive marketing from Xenadrine EFX, CortiSlim, TrimSpa, and One-A-Day WeightSmart--some of the very products that Diet Classics' formulas emulate. The tobacco companies contested their liability, arguing that the Federal Trade Commission (FTC) had sanctioned the use of descriptors such as "light" and "low tar," and that because they were "authorized" to use these terms, they could not be held liable for deceptive marketing practices under RICO. And we've told Frito-Lay that we intend to sue over deceptive marketing of Light chips, which are a repackaged version of its olestra-containing WOW chips. |
