This rule applies when travel keeps an employee away from home overnight - unless the employee is a driver instead of a passenger.
Generally, employers use per-diem allowance arrangements to reimburse employees and independent contractors for business expenses incurred while traveling away from home overnight on business.
IRC section 162(a)(2) permits taxpayers a deduction for travel expenses such as food and lodging when they are away from home overnight.
